The Lawyers offers research directions in relation to records from the databases of national, European and international, in accordance with the criteria specified in the regulations of national, European and international force are in. This research helps to estimate of a potential risk of refusal of registration forms and selection of a trademark to be registered in an appropriate manner. After the realization of the research, we put an application for trademark registration to get them into a particular legal system.
We prepare the documents request and advise regarding the classification of goods and services. Also drafted rules for use of common trademarks and commercial trademarks guaranteed common. After registration we provide supervision necessary to maintain and protect the exclusive rights granted. We inform our clients on the establishment of official duty or at their request we will determine these fees.
In cases of violation of exclusive rights, initiate or take part in administrative procedures for nullity (invalidation) rights protection of the trademarks. On behalf of client we prepare documents warning for any trademark violations. We realize mediations in conflicts in order to reach an agreement between the parties. Furthermore we complete tasks of mediation to end trademarks license agreements and assignment of exclusive rights between the parties, as well as before the competent administrative authorities.
Regarding industrial designs we provide the completion of application for registration of industrial designs national, international and community, and representation of clients before the State Office for Inventions and Trademarks, as well as before OHIM.
Industrial design is the shape of a product or of a part of it, new, with an individual character given especially by the characteristic lines, contour, form, colors and material structure or its product or decoration. Each item realized in an industrial or technique way is a product.
The industrial design registration rights are assured in Romanian national procedure by the State Office for Inventions and Trademarks, and in European system these rights are assured by OHM in Alicante city, Spain.
